The councilors of NC-BC in Mogán ask the municipal auditor to extend the inspection of the contracts

Nueva Canarias de Mogán Sunday, November 12, 2023

After the latest accusation by the mayor of Mogán, there are three open judicial processes investigating possible splitting of contracts.

Nueva Canarias understands that in light of these facts the auditor must carry out a complete scrutiny, to guarantee the protection of general interests and prevent future irregularities.

The councilors of NC, Javier Romero and Juan Manuel Gabella, have today registered a letter addressed to the municipal auditor, in which they request that he extend the inspection period of minor contracts to July 2015. In this way, The inspection and control of all minor contracts would be carried out from the arrival of Onalia Bueno to the mayor's office of Mogán

For the nationalist councilors, their request is justified in the third opening of a judicial procedure, in which the possible splitting of minor contracts is investigated in order to avoid the procedure, which the public sector contracts law establishes, to allegedly favor certain companies, avoiding the free competition enshrined in said legal body.

NC is aware of at least three judicial proceedings opened against political officials of the Mogán City Council, for supposedly cutting up minor contracts. In this sense, they recall that the Maspalomas investigative courts, specifically number 3 and number 1, are investigating councilors Mencey Navarro, Rayco Guerra and the mayor of Mogán for the alleged commission of a crime of administrative prevarication due to the subdivision of contracts.

These facts constitute solid indications that the municipal auditor must take into account to carry out a more exhaustive control, covering a longer period and being able to detect irregularities that could have been committed by the political leaders of the Mogán City Council.

In this sense, the nationalist councilors emphasize in their writing that the temporal scope of any investigation should not be arbitrary, but respond to the logic of the audited events and the applicable legal framework. In the case of alleged irregularities in the division of public contracts for the purpose of their direct award, without subjection to the principles of publicity and competition that govern public procurement, there would be possible acts of administrative prevarication, indicative of other crimes. such as bribery, or embezzlement of public funds that must be clarified by the courts.

For NC, it is evident that, given that two of the investigations refer to contracts prior to 2018, the request for review and control by the auditor must cover a broader temporal scope and prior to 2019, otherwise it would be, in a certain way, considering as lawful contracts that violate contract law.

The intervening function is to guarantee that economic-financial management conforms to the principles of legality, efficiency and economy. Not extending the investigation period compromises not only the clarification of the truth and the possibility of restoring the disturbed legal order, but also citizen confidence in its institutions.

The councilors of NC, Javier Romero and Juan Manuel Gabella, have shown their confidence that the municipal auditor will agree to the request, and review all the minor contracts carried out since Onalia Bueno is mayor, to guarantee the right of every citizen to a good administration, a principle enshrined in the Charter of Fundamental Rights of the European Union and recognized in our legal system.
